1. About This Policy

LuneaPMS ("LuneaPMS", "we", "us", or "our") is committed to protecting the privacy of individuals who interact with our Platform and services. This Privacy Policy explains how we collect, use, disclose, and manage your personal information in accordance with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs").

This Policy applies to all personal information collected through luneapms.com, our email communications, third-party platforms through which our products are sold, and any other touchpoints between you and LuneaPMS.

By using our Platform or purchasing our products, you consent to the collection, use, and disclosure of your personal information as described in this Policy.

2. What Personal Information We Collect

2.1 Information You Provide Directly

We may collect personal information that you provide to us, including:

  • name and email address (when subscribing to our mailing list or purchasing a product);
  • payment information (processed by a third party — we do not store your card details directly);
  • responses to surveys, feedback forms, or direct communications with us;
  • information shared in replies to our emails; and
  • any other information you choose to provide when contacting us.

2.2 Information Collected Automatically

When you visit our Platform, we or our service providers may automatically collect:

  • IP address and approximate geographic location;
  • browser type, version, and operating system;
  • pages visited, time spent on pages, and navigation paths;
  • referring URL and exit pages; and
  • device identifiers and usage data.

This information is collected through cookies and similar tracking technologies. See Section 8 for our Cookies Policy.

2.3 Information From Third-Party Platforms

When you purchase through third parties or interact with our third-party email sequences, those platforms may share certain information with us (such as purchase confirmation and email engagement data) as described in their respective privacy policies.

3. How We Use Your Personal Information

We collect and use personal information for the following purposes:

  • to process and fulfil your product purchases;
  • to deliver Digital Products to you via email or download link;
  • to send transactional emails related to your order (including order confirmations, delivery, and support);
  • to send marketing and promotional communications, including our email sequences and product announcements (where you have consented or where permitted by applicable law);
  • to personalise your experience on our Platform;
  • to improve our products, services, and Platform;
  • to analyse usage and purchasing behaviour to better understand our customers;
  • to comply with legal obligations; and
  • to enforce our Terms of Service and protect our rights.

4. Legal Basis for Processing

We process your personal information on the following legal bases (to the extent applicable under the Privacy Act and any applicable foreign law):

  • performance of a contract — to fulfil your order and deliver products;
  • consent — for marketing communications (you may withdraw consent at any time); and
  • legitimate interests — to improve our services, prevent fraud, and operate our business lawfully.

5. Marketing Communications & Opt-Out

If you have purchased a product or subscribed via our lead magnet, you will be enrolled in our Klaviyo email sequences. These sequences include product onboarding, educational content, and promotional offers related to LuneaPMS products.

You may opt out of marketing communications at any time by:

  • clicking the "unsubscribe" link in any email we send; or
  • emailing info@luneapms.com and requesting removal.

Unsubscribing from marketing communications will not affect transactional emails related to purchases you have already made.

6. Disclosure to Third Parties

6.1 Service Providers

We disclose personal information to third-party service providers who assist us in operating our business. These providers are authorised to use your personal information only as necessary to provide services to us and are required to maintain appropriate confidentiality.

6.2 Other Disclosures

We may also disclose personal information:

  • to comply with a legal obligation, court order, or lawful government or regulatory request;
  • to protect the rights, property, or safety of LuneaPMS, our customers, or the public;
  • in connection with a merger, acquisition, or sale of business assets; or
  • with your consent.

6.3 No Sale of Personal Information

LuneaPMS does not sell, rent, or trade your personal information to any third party for their own marketing or commercial purposes.

7. Overseas Disclosure

LuneaPMS is based in New South Wales, Australia. As noted in Section 6.1, some of our service providers are based in the United States. When we disclose personal information to overseas recipients, we take reasonable steps to ensure that those recipients handle your information in a manner consistent with the APPs.

By using our Services and providing your personal information, you consent to the transfer of your information to countries outside Australia, including to the United States, in connection with the service providers described in this Policy.

If you are located in the United States or another jurisdiction with specific data protection requirements, you should review the policies of the relevant service providers and contact us if you have questions about cross-border data transfers.

8. Cookies & Tracking Technologies

8.1 What Cookies We Use

Our Platform may use cookies and similar tracking technologies (such as pixels and web beacons) to:

  • recognise returning visitors;
  • analyse Platform usage and performance;
  • enable advertising retargeting (via Meta Pixel and TikTok Pixel); and
  • support the functionality of our third-party service providers.

8.2 Managing Cookies

Most browsers allow you to control cookie settings through your browser preferences. You may choose to disable cookies, though this may affect the functionality of certain parts of our Platform. You may also opt out of interest-based advertising through your platform-specific advertising settings (e.g. Meta Ad Settings, TikTok Ad Settings).

9. Data Security

LuneaPMS takes reasonable steps to protect your personal information from unauthorised access, misuse, loss, modification, or disclosure. We implement appropriate technical and organisational measures including:

  • use of reputable, industry-standard third-party platforms for payment processing and email delivery;
  • limiting access to personal information to personnel who require it; and
  • use of encrypted connections (HTTPS) across our Platform.

No method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security and are not liable for any breach that is beyond our reasonable control.

10. Access, Correction & Deletion

10.1 Your Rights

Under the Privacy Act and APPs, you have the right to:

  • request access to the personal information we hold about you;
  • request correction of any personal information that is inaccurate, incomplete, or out of date;
  • request that we delete personal information we hold about you (subject to our legal obligations and legitimate business needs); and
  • make a complaint about how we have handled your personal information.

10.2 How to Exercise Your Rights

To exercise any of the above rights, please contact us at info@luneapms.com. We will respond to your request within 30 days. We may need to verify your identity before processing your request.

Access requests will be responded to free of charge unless the request is complex or made repeatedly, in which case we may apply a reasonable administrative fee.

11. Retention of Personal Information

We retain personal information for as long as necessary to fulfil the purposes for which it was collected, including:

  • for the duration of any ongoing commercial relationship with you;
  • as required to comply with legal obligations (including tax, accounting, and record-keeping requirements); and
  • as reasonably necessary for our legitimate business interests.

When personal information is no longer required, we take reasonable steps to destroy or de-identify it.

12. Children's Privacy

Our Services are intended for adults aged 18 and over. We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has provided us with personal information, please contact us and we will take steps to delete it promptly.

13. Privacy Complaints

If you believe that LuneaPMS has handled your personal information in a way that does not comply with the Privacy Act or the APPs, you may:

  • contact us directly at info@luneapms.com — we will acknowledge your complaint within 5 business days and aim to resolve it within 30 days; and
  • if you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal obligations, or service providers. The updated Policy will be posted on our Platform with the revised effective date. Your continued use of our Services following any update constitutes acceptance of the revised Policy.
